Hypothetical: Being jailed whilst prescribed cannabis

As title suggests. This is a total hypothetical medicated thought 🤣.

If you were a medical patient and ended uo going to jail would the prison have to permit your use of cannabis?

Indeed..but in liquid form this isn't an issue.

I have been wondering about this, I have a trial coming up for an assault (was self defence) chance I could go to prison. Even if legally they had to give access to meds, I just couldn't see them allowing this.

Not to mention even if you would be allowed. You're ass would get robbed as soon as the other prisoners found out ur getting it legally

Patients get methadone in prison so very interesting, I wonder if because it’s private you probably wouldn’t get it in there. Good question though I’d love to find out the answer too, but my bad bwoy days are over 😂

I was a naughty boy back in 2012 and given a 4 year prison sentence and taking a lot of morphine tablets, Oramorph , ADHD meds. Wasn’t on the medical cannabis at the time. I had no problems for the first year and a half as it was a Cat B prison with 24 hr medical cover so could get my oramorph given to me at the medicine times and also get it late at night when banged up. Obviously kept it to myself what I was on. The problem with prison is I couldn’t see them being able to let you have the vape but they could give you the oil in a controlled setting and keep it quiet or you would be picked on by the others that want it from you.

Almost certainly not. For starters, you'd only get the equivalent of NHS care. So unless you're one of the very rare NHS patients you're out of luck.

Secondly, prison healthcare has a modified prescribing scheme - as well as the patients needs they also factor safety and security considerations. For example, unless you were hospitalised they would not prescribe/dispense opioid patches (e.g. fentanyl or buprenorphine) because they can be too easily diverted (that is to say, taken off and given to another inmate). Instead you would likely be given an equivalent dose of extended release morphine tablets which would be dispensed (and taken) under supervision.

In the very unlikely situation that you were allowed to have MC, you wouldn't be able to manage your own dosing. You'd have to go to the infirmary and have a dose given under supervision and it would be exactly to the letter of your prescription.

I get the question. But as it’s essentially private, I would say probably not...... adhd medication may be different but even then it would be extremely regimented when administered and I don’t believe that you would be allowed to vape in prison, oil possibly but even then it would have to be administered by a nurse. That’s possible, maybe 🤷‍♂️ vaping flos is out of the question.

I have seen some stuff online for provisions for fp10 applications for prisoners who have been released early and don't have healthcare provision from a GP on release, these refer to people with opiate dependencies.

I would assume you loose the right to private health care while locked up.just like you loose the right to choose your food supplier

It is an intetesting question. What would the alternative be?

If an incarcerated patient were to have the approval of the prison medical staff there should be no reason they can't.

A judge would have to take consideration of any healthcare needs when sentencing.

I don't wanna be the one that tests this particular what if.

Would an individuals human rights to access medication be extended to a medical cannabis patient in jail? Somehow I don't think the authorities would take kindly to such a request.

Going by what the “news” says, you’d probably get better cannabis in jail than you do outside. Interesting question because it is a legal prescription.
