Prescription Seized by Police Scotland.

I ended up in Hospital on Monday night following a mental health episode & use of ketamine. Stupid i know. The police took my flat keys from were in my pocket. Apparently, they wanted to make sure that my flat was securely locked for whatever reason... Little did I know, 4 officers entered my property, snooped around and Seized my medical cannabis that was in the kitchen, along with my car keys. Upon being discharged from hospital I was told that the police wanted me to collect my prescription and car keys at the local station. Well, they straight up refused to return it to me because it's a class B drug. I desperately tried to explain that it's a Legal prescription etc and that what they're doing is illegal. They won't give me contact details for whoever is in charge. What the fuck do I do?????

If they follow through with this then I wouldn't be surprised if you get compensated for their incompetence if you were to seek it.

I had a quiet humourous conversation with the police today actually. I am due to be a witness at court in January for being a victim where me and my friend were quiet badly attacked. I won't go into more details because it was covered on BBC and ITV.

They asked about if we have any prescriptions we need etc and our needs at court.

I explained I'd just become a medical cannabis patient and have a legal prescription and questioned what the situation would be if I was to need to medicate at court. Obviously being a witness, I will be there from first thing in the morning until I have to give evidence.

They advised that if I needed to then it's best not to take it into the court with me as I wouldn't be able to take it in but that I could leave it in the car and use it if I needed to.

It's actually the police who are taking me to court just to avoid any issues and get me in the court quicker to a secure location so if I was to take it, I will be leaving my weed in the police car and I'm assuming they will escort me to have a vape if I need to. 😂

I really want to test this out but at the same time I don't want to push my luck. Lol

What would others do in my situation? I'm sure I'm going to be extremely anxious for the day waiting to give evidence.

Rinse them for all they are worth and raise hell. They overstepped massively. These people only learn if consequences affect them. I’m stupefied every time these lot don’t get why they are overwhelmingly distrusted and disliked. Bullies.

What would happen if OP reported their actions as a crime? I'm assuming they have produced proof of their prescription and invoked their statutory medical defence.

I would firstly get in touch with your clinic, they should (depends on clinic) put your case forward to the officer in charge, often fighting adamantly on your behalf. They should also issue an emergency script to tie you over. Then post again letting us know how you got on with the clinic and what help they provided, so we can all be ensured to either grace them (or not) with any more custom (an extra incentive for them if they are watching). Secondly, once this is sorted, and more importantly, your MH is stable again, you could goto the newspapers to let them know what happened, (feel free to dm me if you need contacts) and maybe consider speaking to Guy from Seed our Future (a lawyer established on cannabis law). I sincerely wish you all the very best.

You need to make a complaint. They have searched your house without a warrant, they had no right to enter and remove anything. Never mind withholding your medication

Walk into the station and demand they get you in contact with a police supervisor (legal requirement for them to do it if asked) and escalate as much as you can this is a complete abuse of power , sorry this happened to you.

I'm in the exact same position minus working about on ket finished with drugs, took more than enough of my share over the years.

It's a waiting game for me the uniformed spastics seargent is trying to do me with possession of cannabis and pretty much pleaded with me to accept a police recorded warning. Told him to go fuck himself im waiting for the courts. They actually phoned my old clinic which I was surprised about so they are trying to hit out with because I never had a vaporizer with me I must have been smoking it.

They have no idea how to proceed

OK so there’s a few things to unpack here.

The police *could* argue that they entered your premises under the auspices of ‘checking whether the occupant is at risk because of mental illness’. Usually this would be if you were in there and unresponsive but they’ll probably argue that the Ketamine episode/OD meant that they needed to enter the premises to make sure it was safe for you to return.

However, they do not have the right to root through your stuff, unless:

To rearrest an individual who has absconded from custody
To save a life or prevent the destruction of property
To enforce an arrest warrant
To respond to a serious breach of the peace
To recover evidence after an individual has been arrested

Were you arrested at the hospital and cautioned whilst coherent? If not, there’s a defence here.

However, if your MC was sitting on the kitchen counter they’ll argue they didn’t ‘search’, but that it was within eyesight.

So as you can see, you are absolutely in the right, but as far as manipulating the law it’s a bit murky and so I would get a solicitor ASAP.

I also don’t believe that the UK police are legally required to give you their name or badge number, meaning that unfortunately they are also within their rights to refuse to refer you to a superior officer.

Look, ultimately the police may or may not have broken the law regardless of how disgraceful their behaviour here. I would firmly bet on that they will be able to prove that they haven’t.

That being said, for an issue as minor as this in the grand scheme of things if you kick up a fuss I imagine you’ll get your meds back and any potential further action dismissed as an NFA. What I wouldn’t expect is any kind of compensation as the fact that you were in the hospital under the influence of ketamine and undergoing a mental health episode probably negates any wrongdoing on their part. Not morally, but legally (and that’s all that matters unfortunately).

Lawyer up, they're in deep shit for entering your property without permission and removing your belongings - you need a lawyer that knows how to handle this type of thing because they're going to collude to corroborate their story and say you gave them the keys and permission whilst heavily intoxicated/not of fit mind due to a mental health episode.
