Medical cannabis at work update

High all!
So it’s about 3 years since getting my script and declaring it to work.
First three months I was left alone with it (oils only)
Switched to flower and then after second manager found out I was drug tested and subsequently suspended on full pay for 13 months pending a risk assessment and investigation.

I was brought back from suspension after asking for my outstanding holiday and bonus payments to be made.
The risk assessment had not been completed.

As soon as I was brought back I started a grievance claiming they had discriminated against me.

It took a further few months to get my outstanding payments and I put in a claim for compensation for damages and discrimination.

The conclusion of the grievance was they admit it took longer than it should have to process but they did not discriminate. They refused to pay any compensation so I started a tribunal case with ACAS.

They refused to settle before tribunal and I am currently waiting for that to start - they could settle before the tribunal still but I am less likely to do so as I feel I have a strong case.

Recently I asked for a space to medicate indoors, suggesting using the mental health or first aid room - you would have loved to see the manager squirm when I asked lol.
That request is currently going through the ranks - H+S and legal 😂

It’s been a long and difficult journey at times but here we are, getting closer to where things should be!

Sorry to hear this happened to you mate. I feel so lucky that I was able to speak to my Occy Health and they were fantastic. I work as a nurse in the NHS and my trust has no issue with it.
They stated that it's the same as people taking opiate prescription, they trust the person to judge their own fitness, as we are accountable for our actions

What a warpath, inspiring my guy, and hinestly exactly what I'd do. Fuck the man! I hope you get them in a shitheap of trouble. May you get every penny you're entitled too, may they have to pay a stupid settlement that will improve your quality of life substantially, and may you keep fucking with managerial staff until you are done with that place. Sue the fuck out of them my friend, and then let me know when you win so I can laugh along with you!

I cannot believe that three years on you’re still having to deal with this nonsense. Just goes to show much of a ‘family’ most workplaces actually are, no?

Are you a member of a trade union? If not then they may not be able to take up this dispute on your behalf as it’s already ongoing. If you are, great; try and offload as much to them as you can. It’s their job.

Make sure to take care of yourself while fighting the good fight, and I wish you the best in the face of whatever nonsense the system throws at you. Got to strike the balance between fighting against systemic discrimination vs looking after yourself well enough to be able to continue the fight. Environment around you is a big part of that. Make sure you surround yourself with supportive people if possible!

Yes my company has paid me full plus bonuses, but a year without overtime has been hard with a £200 a month cannabis prescription.

Sounds like how I expect my employer to react. I haven't told mine officially yet, I work in a production environment, lots of power tools and heavy plant on site, although I don't use them in my job. I expect they will try say the environment is too dangerous.

So in the meantime I am using the reporting system at work for h+s observations, building up loads of reports to counter any suggestions that I will be at risk or a risk in anyway to h+s.

Dude you're a legend. Thank you for fighting for not just your rights but making it easier for others to get the same treatment. I hope I'd have the stones to do what you are in the same situation, but it's easier said than done and you should be so proud of what you are doing.

UK law leans so heavily on legal precedent, so in a horrid way the higher the court that ends up deciding on this the better this could be for others. Tho I really hope this gets sorted a soon and with as little stress as possible for you.

You're definitely making the country a better place for medicial cannabis patients with what you're doing! The more companies realise trying to be obstructive with employees prescribed medical cannabis will end them in loads of arseache the less they'll do it.

So you had 13 months paid leave and then complained about losing your holiday entitlement? Well done for living up to the stereotypes. Why do you need a place to smoke at work? No consideration for your colleagues? Something tells me they're taking so long with the risk assessment because they're getting better value for money by just paying you not to be there.
