I’m in a similar position, was arrested and blood taken. Refused to even see or acknowledge my prescription and in doing so completely failed to adhered to police procedure and their code of ethics too.
I’m in court next month for it, I’m confident it’ll be thrown out as I’m covered by the medical defence.
Clinic have been great, provided me with confirmation of patient and prescribed status letter, have my prescription covering for the date I was arrested (and well before and up to now too)
Best advice I got was to contact seed our future (they’re on Facebook), they have been absolutely wonderful and have held my hand throughout the situation, on hand whenever I’ve needed them even by phone, made a complaint to the police too for me which is currently being investigated a it’s serious enough, and have helped me get ready for court too.
I haven’t needed a solicitor as a result of their support, and thankfully too as it’ll only cost me donating to them voluntarily
Obviously I have a niggle at the back of my mind it could all go completely tits up in court somehow, but truth is there no reason it could or should and I’m pretty confident of retaining my license as a result of the law
I’ve not be charged or arrested with impairment, just section 5a of being over the limit of not legally prescribed

Not got anything back of them. I had it all on me in Anne bag with the prescription invoice but they weren’t interested. Pointless having a medical prescription if officer aren’t recognising it’s legal

Time to find a solicitor I think. There's others on this sub that can point you in the right direction or even you should search on here for that.
Regardless of the bloods, you have a medical defence. Bloods alone will not prove impairment.
Also, contact your clinic immediately for advice and request a letter from them to forward to the police.

I’ve got a meeting with a chief inspector to provide my prescription and get some clarity over the laws regarding medicinal cannabis at 3pm today at Liverpool headquarters.
What can I state to say they havint followed the pace act or anything else they could of done wrong.
They searched myself and vehicle before making an arrest. Is this something I could bring up. I’ve just read this from the pace act ya see.

one thing i heard recently is they have to observe you for 10 minutes before pursing a roadside drugs wipe. unsure how true it is though
obviously your case is an easy win because of the prescription. i’d start gathering evidence and putting in a subject access request for bodyworn/CCTV while you speak to a solicitor

Wow looks like a few of you have compo on the way. Ensure you document it all and pass it all to the judge then file a police complaint per issue so they stack. We are currently campaigning for the home office to educate its officers in the law change of their most heavily policed drug. The UK police reddit sub here admits their is no process to educate officers on law changes but didn't take the criticism well and banned me

Having been through this myself albeit not in a medical capacity, my defense was that i wasnt impaired and that the police lied about why they stopped me and changed their reason and then said if it wasn't for my car being janky then they probably wouldn't have pulled me over. Even though it had passed an MOT a month prior.
The police treated me so badly, wouldn't let me go to the toilet even though they want a blood test, wet myself all the officers laughed at me and i didnt get a change of clothes for 2hrs, refused to let me speak to a solicitor, had bloods taken hen they kicked me out at 12:30am in winter with no mobile or way to get home, on top of one of the officers being abusive to me the entire time.
I told the magistrates all this and one responded and said "whats that got to do with anything?
The police can stop you in a vehicle for any reason"
Id recommend speaking to the duty solicitor on the day to see if he will represent you (completely free). Turns out the prosecution or the magistrates dont care how the police actually treat people. I was charged with DG10 in the end. Then found out years later than the labs that my county uses were found to have given false blood results back. Tried to get it sorted but the solicitors told me that it had been to long after my conviction. Proof -

I lost my licence over 2 years ago. I was driving along unimpaired and was pulled. For a brake light being out. I was straight away drug swiped and bretherlized . I past that but failed the drug swipe. So was taken in for a blood test. After which I was then taken straight back to my car to then be told I'm free to drive until my court hearing. I suffer from PTSD I also have major anxiety issues. So because of this and a incident which happened to myself right near the court when I was younger. Led me to postpone twice at court. I rang them on the date of the hearing on both occasions to be told that's fine. Well a few days later. 3 police officers turn up at my address banging on my door. I freaked out. I hadn't had any of my medication and they arrested me to take myself to the local nick to be held under arrest until my court hearing. Finally I got my hearing. Explained why I didn't make court. Explained how I was not impaired driving also. Which was also backed up by the police officers statement. And they banned me for 23 months and a big fine. In this time I've suffered a nerve condition and been put on all sorts of other medication. I'm now classed as disabled. And I now have a legal prescription for medical cannabis. The only sad thing is I've done my time. I'm on pip and now I have a mobility car coming. I've been told by them that I can not get insured on this car for another 3 years because of my ban. Does anyone know if there is in anyway I can appeal this so I can drive my mobility car. I feel this is so harsh. I've spent my time yet have to then go through it all again for another 3 years. I used cannabis to self medicate back when I was caught. I now have a prescription for it. But my Dr at the time did know I was using it. As I was fully open with my health professionals due to my breakdown I had. And being diagnosed with PTSD.

Non prescribed psychoactive substance (dvla) are the problem, yours is prescribed, so you should be sweet. Look into common law if your going to defend yourself. Good luck :)

Yeah it's a big problem. You'd be better off driving around with prescribed opioids or benzos in your system, that's the joke. I believe I'm a better driver when I'm stoned - slower, more cautious. Mind you a lot of drinkers think they're better drivers after they've had a few so maybe that's not a good gauge.

It is terrible that they don’t know the law, so many police officers are so oblivious it makes you wonder what else they don’t know.
Can I ask why you were pulled over though? Was it just a random stop and search? If that happened to me I think my anxiety would sky rocket and I’d probably have a mental breakdown. Best way to spread the word, media but they won’t highlight this issue. How can they police effectively when they don’t know the law?

Jumping on this to ask a relevant question. What is “impairment” considered to be and how would they ever be able to prove you are impaired because of your medication? Considering tolerances are different for everyone and people just make mistakes sometimes.

Speaking from experience Unfortunately you'll lose your license if they took your blood and you are over the legal limit. Apparently 'the law is the law' and these doctors/clinics shouldn't be given advice such as 'you can drive if you don't feel impaired' I got done a few months ago and got disqualified from driving for 12 months this is also in Liverpool. Also if they took your medication you won't get it back they taken mine a year ago in a different situation and I still havnt had any luck or even heard anything back.

The CPS decide whether a case is worth taking to court or not. I am surprised that they agreed, considering you had mitigating circumstances. However, they have charged you with a motoring offence, not possession. The blood test will go against a standard, just as blood alcohol does. This is what they will guage with whether you were impaired or not.
The same goes for ANY medication. I take morphine on a daily basis, but I have a tolerance to it but if I take excess, I know not to drive for 24 hours or so.
Make sure you were complying with your prescription when they nicked you. They will only prosecute beyond all reasonable doubt. If you know the charges, try to aim towards bringing doubt. Ask for the testing equipment calibration, officer statements... Don't expect the law to work in your favour without preparing at least a skeleton argument against their charges.
I spent 15 years in criminal Investigations, whilst not at a police level, the law is still under the criminal aspect, so I know a bit about reading the law. Not a solicitor, but a paralegal. This is the problem.
You can still only drive under the drug drive limit.
This stands at a ridiculously low amount and you will fail if you smoked 24 hours earlier.
The prescription doesn't undermine laws it just states your allowed to smoke it personally.

You can get prescribed smack but you wouldn't be able to drive and get pulled / get away with it.
Medication is for personal private use.

Cant believe you are annoyed you got stopped by police. you even say yourself that your blood level will be high. A prescription isn't a free pass to drive while high or under the effect of drugs. Same as raking any medication that says causes drowsiness or impairment, you can't take a dose of morphine,bunch of codeine or any medication and then drive about on it and when the cops pull you, wave a prescription in their face and say ,I'm allowed cannabis. Yeah mate you are but you still ain't allowed to drive while high.
